Question: Discuss about the Ethical Dilemma regarding Jobs For You. Answer: The assignment is discussing about a company named Jobs For You, which is an employment agency that is specializing in the filling of short-term, casual labour needs. However, in the current scenario, there has been the involvement of the company in different court cases, as the employees claimed that they had faced unfair treatment or termination from the companys end. The company, on the other hand used different arguments regarding different cases. For instance, they stated that it is not possible for a short-term labour hire organization like theirs to offer guarantee of work. In another scenario, they cited that work was offered to the staffs on various occasions but the employees kept refusing since the client site was at a very faraway location or the payment was not enough. It was also stated by the company that they had kept record of phone calls and interactions with the staffs as evidences. This revelation by the company however created an uproar amongst the staffs and as a result, they made an appeal to the national privacy legislation for giving them the permission for viewing their own records (Weiss 2014). This was a concerning matter for the management of the company as because, there was every possibility for the staffs to say that the organization was making claims that were false or discriminatory. In this regard, the management of the company has now given clear instruction to the HR staff to have absolute sincerity regarding everything they will be recording in their database. Discussion on solving an ethical dilemma regarding Jobs For You ACS Code of Ethics In this respect, there is the need to mention some values from the ACS Code of Ethics that the company should take into consideration for resolving the situation. These are mentioned as under, The Primary of the Public Interest The Company will be placing the public interest above those of personal, business or social interests. The Enhancement of Quality of Life The Company will be striving towards enhancing the quality of life of those influenced by the companys work. Honesty The Company will be displaying honesty regarding the representation of skills, knowledge, services as well as products. Competence The Company will be working in a competent as well as diligent manner in respect of the stakeholders (Webb 2017). Professional Development The Company will be enhancing its professional growth, and that of the co-workers and the employees. Professionalism The Company will be enhancing the integrity within the Society and improving the respect of its members amongst one another (Lindley 2013). ACS Code of Professional Conduct In addition, there is the need to mention some clauses from the ACS Code of Professional Conduct that the company should take into consideration for resolving the situation. These are mentioned as under, Public Interest There is the requirement for identifying those individuals that are potentially influenced by the workings of the Company and considering their interests in an explicit manner. The Company also needs to raise with the stakeholders any potential conflicting situations between the professional activities of the Company as well as legal public needs. The Company is also required advising the stakeholders at the earliest regarding any conflicts of interest or meticulous oppositions that the Company might be having. There is also the requirement for respecting the intellectual property of other individuals. Quality of Life The Company is required understanding as well as giving the necessary consideration regarding the perceptions of those influenced by the work of the Company (Pebdani 2016). Honesty The Company will not be intentionally misleading a client or potential client regarding the suitability of a product or service. Competence The Company is required having the awareness regarding the necessary standards as well as legislation and accordingly take actions. Also, advising the stakeholders of the Company when it will be believed that a recommended project, product or service is not in their best interest. Professionalism The Company is required refraining from any conduct or action regarding the professional role that might be tarnishing the companys professional image (Thomas 2017). Australian legislation The Company needs to follow the Safe Work Australia Act, 2008 that will be applying to this scenario regarding the ethical dilemma. The Safe Work Australia Act, 2008 has created a body called Safe Work Australia towards improving the occupational health and safety outcomes as well as workers compensation arrangements within Australia (Shapiro 2016). From the scenario that has been discussed above, Stella, the recruitment manager will be following a certain course of action that will be involving the ethical principles as well as the codes that are considered having relevance with the crisis that occurred at Jobs For You. The Code of Ethics that Stella has decided to follow within the organization will be focusing mainly on the ethical perspective regarding the employees since, the entire issue that has cropped up is relating to the employees displaying unprofessional behaviour. Therefore, the codes of ethics that Stella will be following in this regard are honesty, competence as well as professional development. If these three ethical traits will get implemented within the organization, then the overall work environment will certainly improve. In respect of following certain professional code of conducts, Stella felt that the organization is required imbibing the clauses regarding honesty, competence as well as professionalism. Stella believes that if these aspects are undertaken then the overall situation of the organization will improve and the employees of the company will become more productive. The framework that Stella will use in this regard is considered as Chris McDonald Framework. The framework will analyse the ethical issues effectively to understand the real factors relating to the ethical dilemma that is taking place within the organization. The framework primarily will be allowing the identification of the moral significance regarding the scenario. The framework will also be allowing the examination of the influence relating to the option that has been selected and whether Jobs For You is satisfied with the decision that has been considered. B.Identifying the interested parties Stella needs to do the careful identification of the individuals having a stake in the decision. Stella is required being imaginative as well as sympathetic in this respect. C.Involvement of the principles Stella is required thinking via the shared values that are at stake to make the decision. She needs to find out whether the ethical decisions that the management is taking can be considered to be fair. D.Sketching out options Stella is required having an imaginative thought regarding the course of option that is available. She is also required designing the different alternatives for devising a set of codes. E.Weighing the benefits and burdens Stella is required weighing the different benefits as well as burdens. The benefits will be associated with the aspect of taking actions in relation with the different pertinent values and the burdens will be including the aspect of neglecting the pertinent values. F.Looking for analogous cases Stella is required thinking of other identical decisions that were considered, the course of action that was taken and whether the decision was good or not. G.Discussing with relevant others This is considered being a very important aspect and if time permits then Stella is required discussing about her decision regarding the devising of a set of codes with as many individuals as possible. She is required gathering different viewpoints. H.Decision in accordance with legal and organizational rules The decisions are aptly depending on legal considerations. The decisions taken by Stella regarding the devising of a set of codes might be influenced by rules that Jobs For You has set. I.Ease with the decision Stella is required finding out whether the decisions that she will be taking for devising a set of codes would allow her being comfortable with her decision or not. (MacDonald 2010) Conclusion In this assignment, it can be concluded that the Company will be maintaining certain ethical codes and follow certain professional code of conduct that will assist the organization in resolving the situation. The Recruitment Manager has also done the determination of certain set of codes that will be allowing the Company towards recording notes regarding the workers without the fear of getting sued by the staffs.
